TERMS & CONDITIONS
PORTBooking online platform is a self-service portal for using, booking and managing harbour services online for both the end-users & port, marina and harbour owners. It communicates check-in and booking requests made from harbours customers through the PORTBooking online platform and app to the harbour service providers who have been registered as users of the PORTBooking online service.
The private limited company Portbooking OÜ (registry code 16171548), founded in the Republic of Estonia, is the holder of rights and service provider of all PORTBooking online services, designs and intellectual property together with a registered trademark for the online booking service and brand name of PORTBooking.
1. USING THE PORTBOOKING PLATFORM & APP
1.1 The use of the PORBooking platform & app requires the registration of a user account. During the registration process, the name and mobile number of the PORTBooking online service user is linked to the respective user account and added to the PORTBooking database.
1.2 Any complaints and proposals for improving the service can be sent to our support team via email support@portbooking.co.
2. CREDIT CARD & BANK TRANSFER PAYMENT CONDITIONS
2.1 The user of the PORBooking platform & app can pay for the booking of marina, berth or any harbour service with a credit card & bank transfer payment. Credit card payment requires the prior activation of the credit card data within the platform & app and acceptance of PORTBooking Terms of Service.
2.2 Using PORTBooking is free for end-users, marina & harbour customers. The total price displayed for the platform & app users before check-in is not different from the price at the harbour, berth or marina. The service fee, which includes payment commission fees, incl. Visa/Mastercard service fees are commissioned from the harbour, marina & berth service provider by Stripe, Inc., San Francisco, California, US and Dublin, IE, when processing the payments.
2.3 The payment process itself is always agreed upon between the customer and the harbour, marina & berth service provider. The respective contract and terms of service of Stripe, Inc. and the respective harbour, marina & berth service providers apply.
3. USING THE SELF-SERVICE IN HARBOURS, MARINAS & BERTHS
3.1 Harbour, marina & berth service providers using PORTBBooking classified ads & listing information about their harbour (description, services, rules, contacts, prices etc) for the platform & app users. The information is managed by the harbour, marina & berth service providers.
3.2 Harbour, marina & berth service providers manage harbour, marina & berth customers pre-paid, classified ads, short-term & long-term bookings to enable check-in & out for harbour, marina & berth customers by skipping the payment request. After the harbour, marina & berth service provider adds an entry of a pre-paid booking using PORTBooking online service, the vessel profile for the user account associated with the entries e-mail address is created automatically.
3.3 After the sign-up process, PORTBooking platform & app user adds a vessel and payment details for check-in & out and paying mobile.
3.2 Harbour, marina & berth pricelists are managed by harbour, marina & berth service providers. The total price relevant for the size of the added vessel and length of the stay is calculated automatically and displayed for the platform & app user before the check-in in the checkout process of the booking of the berth.
3.4 When the vessel is checked in and paid or checked out the service is considered successful.
4. USE OF THE PORTBOOKING PLATFROM & APP
4.1 PORTBooking is a self-service tool for harbour, marina & berth customers to check-in and pay for harbour, marina & berth services via PORTBooking platform & app.
4.2 The use of the PORTBooking platform & app is based on a non-exclusive licence issued by Portbooking OÜ. The licence agreement is valid for a non-limited period and is free of charge for the harbour, marina & berth customer. In case of any faults in the software, we shall endeavour to correct them as soon as possible, but please keep in mind that the functioning of both the platform & app may be restricted due to occasional technical errors and we are not able to guarantee unlimited faultless functioning of the app at all times. We shall also accept no liability for any losses incurred as a consequence of the PORTBooking platform & app not functioning or not being usable in the desired manner.
4.3 As the PORTBooking platform & app is a means of communication between harbour, marina & berth customers and harbour, marina & berth service providers, PORtBooking cannot influence or take any responsibility for the quality or defects of the service. For this reason, we are unable to guarantee the consistently accurate and faultless provision of harbour, marina & berth services located via PORTBooking. For resolving complaints please contact our support team (referred to in clause 1.2).
4.4 The PORTBooking platform & app does not constitute an offer or brokerage of harbour, marina & berth services for customers. The PORTBooking platform & app is not a means for organising the provision of harbour, marina & berth services. It is also not an agency service for finding customers for harbour, marina & berth rental service providers.
5. CANCELLATION AND NO-SHOW
5.1 By making a booking through the platform and/or app, sailors accept and agree to the relevant cancellation and no-show policy of the harbour, marina & berth service provider, and to any additional (delivery) terms of service of the harbour, marina & berth service provider that may apply to their booking. Please check the harbour, marina & berth rules thoroughly prior to making your reservation.
5.2 Late payment, wrong or invalid card details or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the harbour, marina & berth service provider agrees or allows otherwise under its (pre-)payment and cancellation policy.
5.3 If you wish to review, adjust or cancel your reservation, please contact the harbour, marina and/or berth service provider. Please note that you may be charged for your cancellation in accordance with the harbour, marina & berth service providers cancellation and no-show policy or not be entitled to any repayment of any (pre-)paid amount.
6. BY REGISTERING AN ACCOUNT WITH PORTBOOKING A HARBOUR, MARINA & BERTH CUSTOMER SHALL ACCEPT THE FOLLOWING
6.1 PORTBooking shall have the right to add the personal data of the platform & app user to the PORTBooking database and to forward the personal data to harbour, marina & berth service providers in accordance with PORTBooking’s Privacy Policy (https://portbooking.co/privacy-policy).
6.2 PORTBooking shall have a right to make unilateral amendments to the Terms of Service and Privacy Policy and to relinquish the database to third parties. We shall notify the users of changes to Terms of Service and Privacy Policy.
6.3 PORTBooking shall be entitled to forward personal data and bank data to credit card payment intermediaries.
7. GOOD PRACTICE USING THE PORTBOOKING PLATFORM & APP
7.1 As PORTBooking is not a provider or broker of the harbour, marina & berth services, we are unable to influence the quality of the harbour, marina & berth service. Any issues with defects or quality of the harbour, marina & berth service shall be resolved in accordance with the rules and regulations of the harbour, marina & berth service provider or the relevant supervisory authority.
7.2 We expect that the users of the PORTBooking platform & app use the app in good faith and are respectful of the harbours, marinas & berths who offer their services through the PORTBooking platform & app.
